Note: Peter Dick Jr was deceased at time of both chancery cases involving Peter Dick Heirs. Stated in the Chancery papers Peter jr had 3 children, one called Ellen and the other two unknown, each to receive 1/3 of Peter jr's 1/10 share in his fathers estate. His wife Mary was never mentioned. In further readings of the chancery file it appears that these 3 children were orphans, leading this deponet to believe both parents were deceased.

Note: In the 1860 Frederick County Virginia census, John is listed as retired with $4,170 in real estate and $3,201 in personal estate.
No records show that John Dick ever married Mary Barker. All census shows Mary as "Mary Barker" never as Johns wife, plus she had her own personal property. She was buried as Mary Barker. This may show that Mary came into the home after Catherine Dick died to care for John and Catherine's young son. The will of John's states " my son Elijah son of Mary Barker.
Death Record: recorded in Frederick County, Virginia clerks office and transcribed by the clerks office into the present death registrar book, it states that John Dick was 70 years of age, death being March 9, 1865. This would make him being born in 1795. I believe there is an error in his age, it should have read 78 years of age. Originial document needs to be viewed to determine the correct age if given.

In The name of God Amen
I, John Dick of Frederick County, being of sound and disposing mind and body, do make this tobe my last will and Testament as follows;(that is to say) I desire that my body may be buried at the direction of my executors herein after named, and I direct that all of my just debts bepaid out of my estate as soon after my decease as may be convenient. First I give and bequeath unto my sun Uriah Dick five Hundred dollars in gold or silver and also five hundred dollars in bank money for his share of my estate. Second I will and bequeath unto Elijah Dick son of Mary Barker all the rest of my estate both real and personal and I do hereby nominate and appoint Elijah Dick to be executor of this my last will and Testament and do hereby declare these presents to be and contain my last will and Testament. In witness whereof I, the said Testor John Dick, have to this my said last will written upon one sheet of paper and my hand and seal this twenty first day of October in the year one thousand eight hundred and sixty four.

McIntire and Samuel McIntire as his sureties (who justified on oath as to their inefficiency.) entered into and acknowledged bond in the Surety of twenty five hundred dollars conditioned as the law directs and took the oaths subscribed.

This Indenture made the 8th day of October in the year 1841 between William Trotter and Barbara his wife of the County of Frederick and State of Virginia of the one part and John Dick, Aldridge Dick, Uriah Dick and Elijah Dick of the the County and State aforesaid of the other part Witnesseth that the said William Trotter and Barbara his wife for and in consideration of the sum of Six hundred Dollars current money of the United States to them in hand paid by the said John Dick, Aldridge Dick, Uriah Dick and Elijah Dick at and before the sealing and delivery of these presence to the receipt whereof is hereby acknowledged have granted bargained aliened sold claimed enfoffed released & confirmed (-?-) by upon warrant to grant bargain sold alien enfoffed release & confirm unto the part John Dick, Aldridge Dick, Uriah Dick, & Elijah Dick and there heirs and asigns, a certain tract or parcel of land, lying in Frederick County on the drains of Brush Creek, and adjoining the land of John Shirely, John Shade, Jonathan Iden, Mrs. Pugh and Boyd, and bounded as follows- Beginning at three chestnut oaks on the top of Plank Cabin Ridge John Shirely's corner in John Shade's line, there running with the ridge and John Shades and Jonathan Iden's line S 34 ¼ E 149 poles crossing a branch to a dead pine on the south side of a hill in Mrs. Pugh's line, thence with her lines, N 9 e 104 poles to a dead pine in the west side of a hill, thence N 44 E 107 poles to three chestnut oaks on Pine Ridge Boyd's and Mason's corner, thence with Boyd's line, running near the top of the ridge N 33 E 188 poles to two hickories and a black oak on the east side of the ridge John Shirely's corner thence with his line crossing a branch N 46 ¾ W 209 poles to the Beginning Containing three hundred and twenty six acres, more or less - together with all and singular the rights, improvements, hereditaments and appurtenances whatsoever thereunto belonging and the revisions and remainders, rents issues and profits thereof - To Have and to Hold all and singular the premises with the appurtenances hereby granted unto the said John Dick, Aldridge Dick, Uriah Dick, and Elijah Dick, their heirs and assigns forever. And the said William Trotter and Barbara his wife hereby covenant for themselves and their heirs that they are seized of good and indefeasible estate of inherantance in the premises, and that they have good right to convey the same to the said John Dick, Aldridge Dick, Uriah Dick and Elijah Dick in manner aforesaid. And Lastly that the said Willaim Trotter and Barbara his wife and their heirs, all and singular the premises hereby granted with their appurtenances unto the said John Dick, Aldridge Dick, Uriah Dick and Elijah Dick and their heirs and assigns against the said William Trotter and Barbara his wife and their heirs and all and every other person shall warrant and forever defend by these presents-
